However much we all like Christmas the truth is once the turkey has been eaten and the presents opened, it wont be long before we’re into the start of the new year and what an interesting year it’s set to be for the RCI Action Group.

Once we turn in to January our focus will be on our trial window, which remains set at early 2015. Our expectation is that the trial will take place in April, possibly May, if indeed it goes the full way… who knows there may even be a settlement before we reach that point?

All of the hard work of the legal team, the committee and the management team will come down to that trial and to be frank we can’t wait … we’re confident that the legal system will work in our favour and that the balance will be addressed. Although the settlement side of things is important, this campaign is also about individuals grouping together and taking on the corporate giants.

We’ve been contacted recently by a number of members who have asked what will happen once the trial is completed.

It’s an important issue and one worth clarifying. This action is brought against RCI Europe because we believe that the system that they operate simply doesn’t work. If we win the case, and we’re confident we will, there will be a settlement agreed by the parties involved which will then be distributed to members once costs have been removed.

It’s too early to know exactly what that will be but what we do know is that this settlement will not remove your obligation to the timeshare contract that you have, it’s a bit like having a successful PPI claim yet still retaining the credit card. There’s a tremendous amount of activity in the timeshare industry at the moment possibly linked to the fact that the annual fees have just been invoiced. It usually throws up some interesting conversations where customers are disgruntled and timeshare businesses look to justify their invoices. Our round up on interesting news includes:

Some timeshare resorts are claiming ‘we’ll let you out of your contract if you want’. They want customers to believe that they are happy to negotiate contract releases for a fee. Our advice is to think carefully about this: is it wise to enter another contract with a company that sold you the timeshare in the first place?

We often hear it said that ‘timeshare is set to become the next PPI’ and expect that you’ll be hearing more and more about this over the coming months. The basis for this is that people were sold a product that was not fit for purpose and sub standard. We imagine that the industry is bracing itself for a deluge if a precedent gets set in the coming months. It may not be our fight, but we’ll keep you updated.

Lastly, we couldn’t help but notice that ‘Markus Deutsch’ the CEO and Chairman of vacation club, Silverpoint Group Holdings claims that while at Cendant Vacation Rental Group (now part of Wyndham Worldwide) he was responsible for building a 1.2 billion Euro revenue from a business concept developed in 1999 … a travel and club membership and hotel franchising operation. It begs the question ‘is this the revenue from skimming?’

Last month we mentioned that we’d safely gone through the 10,000 mark which was a fantastic achievement. However, what we can now tell you is that we currently stand at just over 11,000 and we’re expecting it to grow even more as we get closer to the trial and as awareness grows even more … who knows where we’ll get to? Watch this space.
